Terms & Conditions
These Terms & Conditions shall apply to all sales through Droples.com, owned and provided by Volantic AB (A Swedish company with organisation registration number: 556725-4890), and will exclude application of any deviating general or specific conditions or terms of buyer. No waiver or modification of these Conditions of Sale shall be binding upon Volantic AB, unless approved in writing by an authorized representative of Volantic AB.
Price and Payment
The prices appearing on Droples.com are quoted in Swedish krona (SEK). Swedish VAT will be added to the price at the current rate of 25%. Prices for customers outside the European Union will be excluding Swedish VAT. The customer is to pay the purchased price and associated delivery fees (including VAT if applicable) in advanced through credit card payment.
Product, subscription and user account
Droples products consist of:
- Droples tag (Drop/Drops): a Bluetooth Smart transceiver device.
- Droples app (free): an iOS and Android app available on Appstore and Google Play for download
- Droples Premium subscription: additional functionality supplied either within the app or through the Droples system other than the app (computer or server based solutions)
The location based services provided by Volantic AB through the Droples services use a combination of 2.4GHz Bluetooth Smart technology and positioning based on assisted and unassisted variants of satellite based and network based positioning systems available in mobile devices. Volantic AB does not in any way guarantee accuracy or validation of the position information obtained or visualized. The resources used to provide the Service offered by Volantic AB are obtained through known methods and in all cases follow the rules of corresponding usages. Droples tag/Drop(s) conforms to FCC, IC and CE regulations
This device complies with part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) This device may not cause harmful interference, and (2) This device must accept any interference received, including interference that may cause undesired operation. NOTE: Changes or modifications to the electronics or enclosure of this product must be expressly approved by Volantic AB, otherwise the user's authority to operate this product may be voided by the FCC. Droples tag(s)/Drop(s) do not comply with any IP standard. No warranties are provided if the Droples tag(s)/Drop(s) are damaged if in contact with water when used. Tests have been conducted to ensure that the Droples tag(s)/Drop(s) can be used in day-to-day applications with reasonable level of water resistance. Volantic AB is in the conclusion of this Agreement, free from liability for damages arising out of errors and defects in Droples products and services, see Liability Disclaimers section.
Droples works on iOS 7.0 and later versions in combination with iPhone 4S and later iPhones and iPads with Bluetooth Smart.
Droples also works on Android 4.3 and later versions and Android phones with Bluetooth Smart. Since there are vast number of Android implementations and phone vendors Volantic AB cannot guarantee support on all Android phone models. We have successfully tested Droples on the Android phones listed in our app notes on Google Play.
Premium subscription will give the customer access to additional functionality and features, either in the Droples app and/or in connection with the Droples system. The premium subscription is based on a three (3) months cost that will be charged to the customer’s credit card periodically at the beginning of each three (3) months period.
The premium subscription is automatically renewed with a new term of three (3) months at the end of the current contract period.
When entering a Premium subscription the customer is given access to the Premium features only after having made an adequate payment, unless the customer is offered a free of charge promotional usage period. The Premium functionality, even if entering a promotional period, requires registration of payment details such as credit card details. The customer can at any time terminate the Premium subscription. All further payment withdrawals will be terminated and the Premium features will be revoked for that account.
The customer will be granted an account on the Droples site. Customer's account will contain customer information, preferences and choices. The customer's user information is sent to the customer's email address. It is the customer's responsibility to keep this information in a secure manner so that it does not become available to unauthorized persons.
The delivery time is confirmed through the order confirmation process and may vary depending on country to which the goods are to be sent. If a service/product has a specific condition on delivery time, this delivery time will be stated in connection to the individual service/product.
In case Volantic AB has reason to question buyer's solvency or ability to pay for delivered products, Volantic AB have no obligation to make delivery, and shall be entitled to stop products under carriage, unless buyer makes advance payment for the delivery and other claims arising from the business relation or grants security which can be reasonably accepted by Volantic AB.
Returning a service/product is to be done at your expense, unless the product/service is faulty or damaged upon delivery. Returned products/services are to be sent as letters or postal packages, and not for COD.
Droples.com return period is 14 days.
Droples.com shall, if under the jurisdiction of our return policy, refund you what you have paid for the product and/or service as soon as possible, but at the latest within 30 days of the product being returned or you informing us of wanting to return a service. You are obliged to pay for the return delivery of the product.
When making a return you must, in writing, clearly state that you regret your purchase. The return period is counted from the day you received the purchased item in full, or a significant part of the product. If you have purchased a customized product or a product with a significant personal customization, the return period is counted from the day Droples.com informed you about the product.
You do not qualify for our return policy if:
- The service you have bought was commenced with your consent during the return period.
- Due to the physical nature of the service, it is not returnable.
- The seal of authentication of the product has been broken or opened.
When returning a product/service:
- You are obliged to keep the product/service in the same condition as when delivered.
- You must not have used the product/service, however you have the right to investigate the condition the product was in when delivered. If damage or harm is caused to a product while investigated, the product does not qualify for the return policy.
Droples tag(s)/Drop(s) are covered by a one (1) year warranty.
This warranty covers only original manufacturing defects, and thus not errors that occur at or after an alternation of the functionality and appearance, such as modification, un-authorized upgrading or other configuration of the product that is not approved by Volantic AB.
Customer order confirmation is to be considered as the proof of warranty.
Customers wishing to claim warranty due to errors detected in the product are to contact Volantic AB using the contact information listed on Droples.com as soon as possible after discovering the defect or error.
Droples app (free or premium) is not covered by any warranty issued by Volantic AB.
Volantic AB is not liable for any damages or inconvenience that may arise when the customer uses the products and services Volantic AB provides. It is always the customer's responsibility to determine the correct use of the product and services Volantic AB provides. This Agreement disclaims Volantic AB from all responsibilities to the client and third parties based on the usage of the product and services provided by Volantic AB. Volantic AB must otherwise be deemed released from all obligations under this Agreement on liability that would otherwise have occurred because of events outside of this Agreement.
Volantic AB seeks a high availability of the website and the services offered, but reserves the right to suspend or restrict all or part of the Site and/or Service of the updates and maintenance for a limited time. Damage or inconvenience arising from a disruption, interruption of operation or a disruption in communications or computer systems of Volantic AB or any of its affiliates or service providers, will not be covered by Volantic AB. Volantic AB will not be liable to indirect damage if any error occurs in connection with usage of the product and services provided in different use cases for the customer or of its partner. The customer shall always be responsible for all the loss incurred.
In case of possible delay in delivery due to events beyond Volantic AB's control, Volantic AB shall not be held liable for damage resulting from such delay in delivery. In such event, the customer is not entitled to damages or other compensation from Volantic AB, unless otherwise agreed by Volantic AB and the customer.
Volantic AB reserves the right to, without prior notice, change the content on the site Droples.com and the product and services provided, which includes, but is not limited to, supply information, prices, promotions and conditions of this Agreement. Volantic AB is not obliged to publish any prior notice for such change.
Intellectual property, logos and trademarks
All materials published on Droples.com, including software, logos, videos, audio clips, trademarks, texts and images are protected intellectual property. Protection means that the material can not be used or copied or otherwise transferred to third parties whether in original or altered form without prior explicit permission from Volantic AB. Any violations to the above will be prosecuted.
Volantic AB is not liable for any non-performance caused by circumstances beyond our control, which directly or indirectly prevents, obstructs or renders production, delivery or freight uneconomical until such obstacle has been removed (force majeure). Such circumstances shall be deemed to include difficulties to procure raw materials, as well as other difficulties and disturbances including, but not limited to, war, riots, labour conflicts, fire, flooding, storms, accidents, fuel or power shortages, transportation shortages, obstacles or interruptions regarding transportation at sea and breakdowns or interruptions of any kind as regards to our equipment or facilities, which are deemed necessary for the performance of our agreements' obligations.
